Kalsi & Associates Raises Concern over The New Insurance Plan in Ontario

Source:

CTV News

THE STAR

A recent report on the state of Ontario’s Auto Insurance Systems shows that we have one of the least effective systems in play. While there’s a decrease in the number of accidents, the opposite is evident on the number of claims. They have gone up.

With the aim of reducing the insurance premiums, the government is working on introducing the “Fair Auto Insurance Plan.” It has been a topic of discussion since last year. This new plan aims at reducing fraud cases and costs in the Auto Insurance industry.

One of the areas of concern by many Personal Injury Lawyers and Kalsi & Associates included is the new plan will make it more difficult for one to qualify for a particular coverage, in case of an accident. Though the project will save the public regarding auto insurance premiums, it may be to the detriment of victims of accidents.

According to the plan, the treatment plans for common injuries that result from collisions will be standard. Also, medical assessment for those with severe injuries due to an accident will be by neutral and independent centers for examination. Now, you will not go to a family doctor or your specialist for assessment.

You will have to go to a designated assessment center. It may result in an assessment that is not comprehensive, thorough, or even well-reasoned. As we wait to see what measures the development plans for this new system will take; feel free to contact Kalsi & Associates at (844) 905-2993, for your Personal Injury cases, or apply online.

Bicycle & Pedestrian Accidents; What you need to Know?

Source:

CBC News

According to a news feature by CBC news in 2015, in Toronto, six pedestrians are hit every day. And the number was increasing. That is so, even though the law stipulates that pedestrians have the right of way.

As the roads become less safe for pedestrians, early last year, a new pedestrian law was introduced in Ontario. It emphasized that motorists should wait for the pedestrian to cross the crosswalks or pedestrian crossovers completely.

However, if you are injured from colliding with a motor vehicle, you are entitled to compensation.

Types of Claims

No-Fault Benefit/ Accident Benefit

It applies to all persons involved in a collision with a motor vehicle. If you are a pedestrian or cyclist, then your auto insurance applies. But if you have no insured car, you can claim the insurance policy of the vehicle involved in the accident.

Claim against at-fault driver

In addition to the above claim, you may also be entitled to claim the driver who is at fault. First, you have to provide proof that some blame, is the driver of the car.

Some of the benefits you can claim if you suffer injuries due to the collision include, medical expenses, replacement of income, etc. It all depends on the circumstances of the accident.

In Ontario, the laws on auto insurance are complex and change frequently. It is advisable to seek the guidance of a personal injury lawyer to advise you on the measures to take. Determining the Severity of an Injury

ABI NETWORK

Are you involved in an accident? Did you suffer any injuries? The common injuries suffered in an accident include brain, neck injury or whiplash and even spinal cord injuries.

If you suffer a brain injury after an accident, how is the severity measured? The seriousness of a brain injury is determined by where in the brain you have an injury. The swelling that occurs and how much of your brain is injured, matters.

Medical experts will conduct tests such as:

  • Electroencephalograms or otherwise known as EEGs
  • Taking CT Scans to help them understand the extent of the injuries to the brain.

However, the tests are not enough to assist in determining how severe the injury is. In such instances, they will need to use additional techniques. Popular methods used are, GCS or the Glasgow Comma Scale, in conjunction with the length of time that the patient has Post Traumatic Amnesia.

PTA is where the patient has troubles thinking, concentrating, remembering, etc. What can you use to estimate how fast one recovers? The recovery time taken by each patient depends on:

  • Their age
  • General health
  • Whether they suffer other injuries
  • The type and seriousness of the injury that they suffer, etc.

The more serious the injuries, the longer it takes to recover. For a FREE consultation approach Kalsi & Associates, a team of personal Injury Lawyers to discuss your confidential matter.
