What To Do After a Minor Car Accident – Ontario, Canada

The sound of bending metal, the sudden jolt, and the moment of shocked silence that follows – minor car accidents in Ontario, although less catastrophic than major ones, can still be a disorienting experience for the drivers involved and their passengers. Understanding how to handle these moments can make a major difference in how you are able to handle the aftermath.

In this article, we cover what to do after a minor car accident in Ontario, so that you are prepared to protect your rights, safety, and interests when tricky situations like these arise.

What is a Minor Accident?

A minor accident typically involves scenarios where damage to the vehicles appears relatively minimal. If the damage to all vehicles involved appears to be more than $2,000 and there are injuries. The Ontario Highway Traffic Act mandates that such incidents be reported to the police as soon as possible.

The Steps to Follow After a Minor Accident

The actions you take following an accident are aimed at ensuring the safety of those involved and helps protect your rights.

Right After the Accident

The immediate actions you take set the foundation for everything that follows.

Step 1: Ensuring Safety

The first priority is safety. Pull over carefully (if possible) and check if you, your passengers, the other driver and their passengers are injured. The accident scene can at times be chaotic, even in a minor accident, but ensuring everyone’s well-being is paramount. If someone has been injured, call 911.

Step 2: Documenting the Scene

Next, document the scene. Take detailed photos and videos of the damage to all vehicles involved. This evidence is vital, in all accidents.

Step 3: Moving Your Vehicle & Exchanging Driver Information

If your vehicle is in the way of traffic and can be moved, move it to the side of the roadway. This helps prevent further accidents and clears the way for emergency services if they’re needed.

This is also the best time to exchange information with other driver(s) involved. Take note of names, contact information, vehicle information, driver’s license and insurance information.

Within 24 Hours After the Auto Accident

The actions taken in the 24 hours following the immediate aftermath are key for legal and insurance purposes.

Step 1: Reporting the Accident

If there is any damage, report the incident to a collision reporting center and/or the police.

Step 2: Contact a Car Accident Lawyer

Consulting with car accident lawyers is a wise next step, particularly if there are any injuries. Lawyers with in-depth knowledge of accident benefits and personal injury law can offer invaluable support and representation.

Step 3: Contacting Your Insurance Company

Notify your car insurance company about the accident as early as you can. They will begin the insurance claim process, through which you may recover repair costs and other losses.

What Are Statutory Accident Benefits In Ontario?

Life can take unexpected turns, and when the unexpected involves an injury, the challenges can be immense. In the wake of an incident resulting from a motor vehicle accident, understanding your rights and the benefits available through statutory accident benefits (SABs) is key to getting your life back on track.

What are statutory accident benefits in Ontario? In short, SABs play a pivotal role in ensuring benefits are available during these trying times. In this article, we’ll cover what SABs are,, the role of insurance companies, how you can go about getting your SABs, and how Kalsi & Associates can help you through the process.

Understanding Statutory Accident Benefits (SABs)

Statutory Accident Benefits are a comprehensive set of benefits provided to individuals who have suffered injuries as a result of a car accident. These benefits are intended to cover various aspects through your recovery journey, ensuring that you receive the medical care, financial assistance, and support you need.

For accident victims, SABs are a beacon of hope in the midst of adversity. They encompass a range of benefits that address the physical, emotional, and financial challenges that arise after an accident. SABs help accident victims through healing and rebuilding their lives.

How SABs Alleviate Financial Strain During Recovery

Recovery can be an expensive journey, with medical expenses, rehabilitation costs, and potential loss of income. SABs are designed to offset these financial burdens. By covering various categories of expenses, these accident benefits ensure that you can access necessary treatments and therapies.

Coverage Under Statutory Accident Benefits (SABs)

Coverage under Statutory Accident Benefits (SABs) underwent significant changes, with new regulations effective from June 1, 2016. These changes introduced standardized coverage levels to ensure that accident victims receive the support they need. Here’s a breakdown of the essential coverage components according to the Government of Ontario‘s statutory accident benefits schedule:

Medical and Rehabilitation Benefits

For non-catastrophic injuries, SABs provide combined coverage of up to $65,000 for both medical rehabilitation and attendant care benefits. In cases involving a catastrophic injury, the coverage increases. This coverage encompasses a wide range of expenses, including medical treatments, rehabilitation therapies, and attendant care services.

Income Replacement

SABs offer Income Replacement benefits, providing up to 70% of your gross income. This benefit is capped at $400 per week, with the option to increase coverage. The amount you’re eligible for depends on your income range. A deductible period of one week applies to this benefit.

Non-earner Benefit

If you’re a student or unable to continue daily life as before an accident, the Non-earner Benefit comes into play. This benefit offers $185 per week, aiding individuals who don’t qualify for Income Replacement benefits. A waiting period of four weeks applies to this benefit.

Caregiver Benefit

In situations where you’re unable to care for a dependent residing with you due to a catastrophic impairment, the Caregiver Benefit comes to your aid. The benefit covers expenses associated with hiring caregivers while you’re unable to provide care. The benefit includes up to $250 per week for the first dependent and an additional $50 per week for each subsequent dependent.

Death and Funeral Benefits

Tragedy can strike, and SABs provide benefits for  Death and Funeral Expenses coverage. In the event of your passing due to an accident, this benefit provides a lump sum payout to the deceased’s spouse and dependents. The standard payout includes $25,000 to your spouse, $10,000 to each dependent, and a maximum of $6,000 for funeral expenses. Enhanced options allow you to increase these payouts.

Additional Expenses Covered

Beyond these core benefits, SABs encompass a range of additional expenses:

  • Lost Education Expenses: If your injuries prevent you from continuing your studies, this benefit compensates for lost tuition, books, and other education-related expenses, up to $15,000.
  • Expenses of Visitors: Certain close individuals, such as your spouse, children, parents, and guardians, can claim reasonable and necessary expenses incurred during visits for up to 104 weeks after the accident, unless the injuries are catastrophic.
  • Housekeeping and Home Maintenance: Catastrophic injuries may necessitate external assistance for housekeeping and home maintenance. Damage to Clothing, Glasses, and Personal Devices: Accidents can damage personal belongings, and SABs may cover the cost of damaged clothing, glasses, and other medical devices.

These coverage enhancements provide benefits to accident victims, ensuring that the financial and care-related challenges they face are addressed. By understanding the scope of SABs, you can approach your recovery journey with confidence, knowing what benefits are available.

Where the Money Comes From

SABs are payable by your automobile insurer. When operating a motor vehicle on the road in Ontario, mandatory automobile insurance is required.

SABs

When you’re involved in an accident, the first step in accessing SABs is to file a claim with your car insurance company. This initiates the process of assessing your situation and determining the benefits you’re entitled to.

Insurance companies are bound by regulations that dictate the process of evaluating and approving SAB claims. These regulations ensure that claims are assessed fairly and consistently.

Navigating the Potential Challenges of Claim Approval

While insurance companies provide necessary support, challenges can arise during the claim approval process. Working with an experienced lawyer can help you navigate these challenges and ensure your rights are protected.

The Process of Getting SABs: A Step-by-Step Guide

Below is a quick guide on the process of securing your SABs:

1) Initiating the Claims Process: Reporting the Accident

Promptly reporting the accident to your car insurance company and applying for Statutory Accident Benefits is the first step in accessing SABs. This sets the wheels in motion for the evaluation of your situation and the determination of benefits.

2) Medical Assessments and Documentation Requirements

Accurate documentation and medical assessments are crucial to establish the extent of your injuries and the support you require. These steps play a pivotal role in securing the benefits you’re entitled to.

3) Evaluating Eligibility and Benefit Entitlement

Eligibility for various benefit categories is based on your pre-accident status and the severity of your injuries.

4) Resolving Disputes

In cases where disputes arise over benefit entitlement or coverage, an application to the Licence Appeal Tribunal (LAT) can provide avenues for resolution. An injury lawyer will advocate for your benefits on your behalf.

What Are The Major Causes Of Road Accidents In Mississauga, ON?

Car accidents can have devastating consequences, impacting the lives of individuals and communities alike. Understanding the major causes of road accidents is crucial for accident prevention and promoting road safety.

At Kalsi & Associates, our car accident lawyers are committed to handling car accident cases and supporting victims during their recovery journey. In this blog, we’ll be examining the leading causes of serious car accidents, as well as the part accident benefits and personal injury lawyers play in the aftermath of car accidents.

Road Collisions by the Numbers

According to the Peel Regional Police Department, which oversees the municipalities of Mississauga, Brampton, and Caledon, there were 33,875 total motor vehicle collisions in 2022. Of those 33,875 collisions, 19,269 were serious enough to be reported to the police, 18,119 involved some form of property damage, 1,116 resulted in personal injury, and 34 were fatal accidents.

Although these statistics are slightly below Ontario’s provincial averages per 100,000 members of the population, the region’s 33,875 collisions represents a 14,456-collision increase from 2021’s total of 19,419.

This drastic rise in collisions reinforces the importance of understanding Ontario’s accident benefits and how a lawyer can help you access them, should you suffer a motor vehicle accident.

The Most Prevalent Causes of Car Accidents

Now let’s dive into the various causes of car accidents in Mississauga:

Distracted Driving

Distracted driving is a premier cause of road accidents. It includes activities, such as texting, using a smartphone, eating, or adjusting the radio while driving. Such distractions divert a driver’s attention from the road and the actions of other drivers, creating the conditions for car crashes.

Speeding and Reckless Driving

Many car accidents occur as the result of speeding and reckless or aggressive driving, such as illegal street racing. Driving above the speed limit not only reduces a driver’s ability to react to unexpected situations but also increases the severity of collisions and the likelihood of rollover accidents. In especially tragic circumstances, speeding drivers can cause fatal car accidents.

Reckless driving behaviours, such as tailgating, changing lanes abruptly, or disregarding traffic signals, also escalate the risk of auto accidents.

Impaired Driving

Impaired driving, which includes drunk driving and driving while high, poses a significant threat on the roads. Driving under the influence affects a driver’s judgment, reaction time, and ability to safely operate a vehicle.

Weather and Road Conditions

During the winter months in many places in Canada, of which Mississauga is no exception, adverse weather conditions set the stage for accidents. Snow, ice, and limited visibility create hazardous roadways, reducing traction and making driving treacherous. Vehicles become prone to skidding and loss of control, increasing the risk of traffic accidents.

When Should You Hire a Lawyer After a Car Accident?

Car accidents are sudden and distressing events that can have a significant impact on individuals physically, emotionally, and financially. Understanding the appropriate steps to take after a car accident is crucial, and one of the key considerations is knowing when to hire a car accident lawyer.

At Kalsi & Associates, our car accident lawyers have extensive experience in handling car accident cases and ensuring our clients receive the support and benefits they deserve. In this blog we’ll cover the steps to take after a car accident, how to recognize if you’re in need of a lawyer, and how they can help you get the benefits you need.

Immediate Steps After a Car Accident

After a car accident, the immediate steps you take can make a significant difference in the outcome of your claim. First and foremost, prioritize safety and seek medical attention if you or anyone involved is injured. Then, make sure to exchange contact details, insurance information, and statements from witnesses.

As a car accident victim, understanding the role of your insurance company and the accident benefits available to you is important. It is essential to file a motor vehicle accident report with the police and inform your own insurance company about the accident promptly. Documenting the accident scene and damages through photographs can provide valuable evidence for your claim.

Recognizing the Need for Legal Assistance

Facing a car accident case can be overwhelming, and knowing when to seek legal representation is key to protecting your rights. While some accidents can be managed independently, certain circumstances call for the expertise of a car accident lawyer.

  1. Serious Injuries and Substantial Medical Expenses: If you have suffered severe injuries that result in substantial medical expenses, seeking legal assistance is vital. A car accident lawyer can advocate for your best interests and ensure you receive the benefits needed to cover medical bills and rehabilitation costs in your car accident claim.
  2. Disputes with the Insurance Company: Insurance companies may dispute your insurance claim or offer inadequate settlements. Having a car accident lawyer on your side can help navigate these conflicts and ensure you get the benefits you rightfully deserve.
  3. Navigating Complex Issues: Determining liability and fault in accidents can be intricate, particularly in multi-vehicle collisions or when fault is not clear-cut. A car accident lawyer can help establish a strong case and ensure your interests are protected.

The Advantages of Early Legal Representation

Early legal representation offers several advantages.

A lawyer can ensure that evidence is properly collected and preserved to support your claim. They also prevent common mistakes that could weaken your claim, such as unintentional statements that could be used against you. What’s more, having legal representation can prevent insurance adjusters from offering inadequate settlements and increase your chances of receiving the benefits you rightfully deserve.

Understanding Car Accident Claims and Benefits

Car accident claims encompass several essential steps that victims must take. Immediately notifying your insurance company about the accident and providing necessary documentation is required for initiating a car accident personal injury claim.

Alongside this process, accident benefits, also known as SABs (Statutory Accident Benefits), are available to support car accident victims in Ontario. These benefits cover various expenses, including medical and rehabilitation costs, income replacement for lost wages, and attendant care. Accessing these benefits can significantly aid victims in their recovery journey and financial stability after a car accident, which is why the expertise lawyers bring to the equation is invaluable.

Handling Minor Car Accidents

In some cases, car accidents may be minor, and legal representation might not be necessary. It is essential to assess the extent of damages and determine if your case is straightforward before involving a lawyer. Dealing with insurance companies directly might be sufficient for a minor car accident.

That being said, dealing with insurance companies can present challenges, including delays, low settlement offers, and denial of valid claims. In this regard, having a car accident lawyer on your side can make a significant difference. Lawyers are skilled negotiators who can advocate for your best interests in interactions with insurance companies.

Pursuing a Personal Injury Lawsuit

In certain situations, such as when negotiations with insurance companies fail to result in a fair settlement, pursuing a personal injury lawsuit may become necessary. Before proceeding, it’s essential to assess the potential costs and benefits of taking legal action.

Car accident lawyers play a critical role in this process, providing invaluable support by thoroughly analyzing your case, advising on the likelihood of success, and guiding you through the complexities of the legal process. Their expertise ensures that your rights are safeguarded throughout the lawsuit, increasing your chances of obtaining the benefits you rightfully deserve.

This benefit covers a wide range of treatments and therapies aimed at helping you recover physically and mentally.

What is No-Fault Insurance?

No-fault insurance is a type of auto insurance that can be confusing for many drivers. If you’ve ever wondered what it is and how it works, you’re not alone.

No-fault insurance, also known as personal injury protection (PIP), is a type of car insurance coverage that covers medical expenses and other related costs regardless of fault determination rules. It is a system designed to reduce the burden on the court system by minimizing lawsuits and legal disputes to determine fault for an accident.

In this blog post, we’ll explore everything you need to know about no-fault insurance, and who it benefits. So buckle up and let’s get started!

Cars in British Columbia on the highway

How No-Fault Insurance Works

Under a no-fault insurance system, each driver is required to carry their own car insurance coverage, which provides coverage for medical expenses and lost wages resulting from car accidents, regardless of who was at fault. This means that if you are involved in a car accident, regardless of whether you caused the accident or not, you can recover medical expenses and lost wages from your own insurance company.

Under no-fault insurance, the process is simplified because the insurance companies of each driver involved in the accident pay for their insured’s medical expenses and lost wages up to a certain limit, regardless of who caused the accident. This means that there is no need to determine fault, which saves time and money for all parties involved.

Benefits of No-Fault Insurance

One of the main benefits of no-fault insurance is that it provides a quicker and more streamlined process for accident victims to receive accident benefits for their injuries. This is because there is no need to go through a lengthy legal process to determine fault, which can take months or even years.

No-fault insurance also provides a level of protection for drivers, as they are able to receive accident benefits for their injuries regardless of who caused the accident. This can help to alleviate some of the financial stress that comes with being injured in a car accident and can provide peace of mind for drivers.

When Do You Need A Lawyer for No-Fault Insurance Claims?

While the no-fault insurance system is designed to simplify the process of obtaining accident benefits for injuries sustained in a car accident, there are situations where it may be necessary to hire a car accident lawyer to help with the process. Below are some scenarios where you may need a lawyer for no-fault insurance claims:

Insurance Coverage Disputes:

There may be situations where your own insurance company disputes coverage for your claim. For example, your own insurance company may argue that your medical treatment is not necessary or that your injuries and medical bills are not related to the car accident. A lawyer can help you navigate the insurance company’s appeals process and advocate on your behalf to ensure you receive the coverage you are entitled to.

Denied Claims:

Unfortunately, there may be situations where you are denied accident benefits by the insurance provider. In this case, a lawyer can help you understand why your claim was denied and advise you on the next steps to take, such as filing an application to dispute any denials.

Long-Term or Permanent Injuries:

If you have sustained long-term or permanent injuries as a result of a car accident, you may require ongoing medical rehabilitation and have ongoing medical bills, as well as future lost wages and other damages. A lawyer can help access your long-term disability benefits.

What are the Benefits of No-Fault Insurance?

One of the main benefits of the no-fault system is that it allows the injured parties to receive accident benefits quickly for medical care, without having to wait for a legal settlement or court judgment. This can be especially important for those who are unable to work due to their injuries and need immediate assistance.

Kalsi & Associates Fights For You

While no-fault insurance may seem confusing at first, it is an important system designed to reduce the burden of determining fault for an accident. By understanding the basics of no-fault insurance and its benefits, you can make informed decisions when it comes to your auto insurance policy.

If you’re ever in a car accident, remember to contact a personal injury lawyer from Kalsi & Associates. They can help guide you through the process and explore your legal options, while you get on the road to recovery.

What To Do After a Car Accident

Car accidents are a common occurrence in Ontario, and knowing what to do in the aftermath of a collision is crucial. Whether you’ve been involved in a minor car accident or a major collision, it’s important to take the necessary steps to protect yourself and your rights.

This blog post will provide you with a step-by-step guide on what to do after a car accident in Ontario.

Post-Accident

damaged red vehicle after a car accident

Here is a guide for what to do following a car accident.

Collect Evidence

After an auto accident in Ontario is to exchange information and begin collecting evidence. This evidence will be necessary when filing your insurance claim for accident benefits

Take photos of the vehicles involved, including their license plates and any damage sustained. Make sure to take photos from multiple angles, as well as any skid marks or debris on the road. In addition, get the contact information of any witnesses who may have seen the accident. Witnesses can provide an account of the events that took place and can be incredibly valuable when it comes time to file a claim. Remember to exchange contact and insurance information with the other driver involved as well. This information will be necessary when filing your insurance claim.

Call the Police

If you or anyone else involved in the accident is injured, or if damage to the vehicles involved appears to exceed $2000, be sure to call emergency services right away. It is also recommended to call the authorities if the incident took place on private or municipal property, if a government vehicle was involved in the accident, or if you suspect any of the other parties to be guilty of a criminal code offence, such as driving under the influence.

The police will come to the scene, assess the situation, and make a detailed report of the accident. This report will be invaluable when filing an insurance claim, as it provides an official record of what happened. Not only will the police report help with the insurance claim process, but it can also be helpful if legal action is necessary down the line.

Seek Medical Help

Injuries sustained in a car accident may not always be immediately apparent, and some symptoms may take days or even weeks to manifest. Seeking medical attention after an accident is crucial to ensure that any injuries are identified and treated promptly.

Obtaining a medical report can be useful when making an insurance claim, as it provides documentation of any injuries sustained in the accident. Even if you feel fine after the accident, it’s important to get a medical evaluation to rule out any underlying injuries or conditions that could cause problems in the future. Remember that your health and well-being should be a top priority after an accident, so don’t hesitate to seek medical help if you need it.

Report the Incident

If the accident resulted in significant property damage or injury, it’s crucial to report the incident to the nearest Collision Reporting Centre nearest to you within 24 hours, especially if the police were not called. The Collision Reporting Centre is a facility that is designated by the Ontario government to receive and document reports of car accidents. Reporting the accident is required by law, and failure to do so could result in legal repercussions.

When reporting the accident, be sure to bring all of the necessary information, including your driver’s license, vehicle registration, and proof of insurance. You will also need to provide details about the accident, including the time and location, the number of vehicles involved, and any injuries sustained.

Contact Your Insurer

If you’re involved in a car accident in Ontario, it’s important to report it to your insurance company as soon as possible. Under Ontario’s no-fault insurance system, the drivers involved deal with their own car insurance companies, regardless of who was at fault for the accident.

When reporting the accident to your insurance company, you will need to provide basic information about the collision, such as the time, location, and nature of the accident. You may also need to provide information about any injuries or property damage that resulted.

Your insurance company will likely conduct their own investigation of the accident, which may involve gathering witness statements or consulting with experts in accident reconstruction. To help facilitate this process, you should provide your insurance company with any relevant information and evidence about the accident, such as photographs of the damage, medical bills or reports, police reports, and contact information for any witnesses.

How to Sue for a Car Accident

How to Sue for a Car Accident

Car accidents can be a traumatic and costly experience. In Ontario, compensation for many car accidents is provided through insurance coverage in the form of statutory accident benefits and therefore do not require a lawsuit. However, if you have suffered significant injuries due to the recklessness or negligence of another driver or third party, you may be entitled to sue for your pain and suffering and future health care costs. You might also be able to sue for losses that have not been covered by your insurance company.

It should be noted that personal injury lawsuits can be complex. It is therefore advisable to consult a personal injury lawyer as soon as possible to help you navigate the legal process. Nevertheless, if you have been involved in a car accident and plan on suing, it is important you understand the steps involved.

Steps for Filing a Car Accident Lawsuit

gavel from car accident court case

Here are instructions to follow after you have been involved in a car accident that will improve your odds of a positive legal outcome.

Gather Evidence

The first step in suing for an automobile accident is an important one – gathering evidence. The key pieces here are taking pictures of the scene, getting the contact information of any witnesses, and securing a police report. These will be necessary components to support your case going forward. It is also important to keep track of any medical expenses you may have incurred as a result of the collision, as well as any days off work that were taken due to the physical injuries received from the accident.

Report the Incident

When it comes to reporting the accident, there are several timelines to be aware of:

  • If the amount of damages exceeds $1,000 or if there has been an injury, you must report the accident to the police.
  • If you want to report an accident and the authorities were not involved at the time, you have 24 hours to report the incident to the Collision Reporting Centre.
  • You have 7 days from the date of the accident to report it to your insurance provider.
  • You have 30 days from the time you receive the Accident Benefits package to submit your completed application.
  • If you plan to sue for the car accident, you must notify the individual you are suing within 120 days of the accident.
  • In all cases, you must file the lawsuit within two years of the incident.
  • For car accident claims against a provincial or municipal government, you need to provide written notice of your intention to sue within 10 days of the incident.

Consult a Car Accident Lawyer

When considering legal action for a car accident, it is recommended to work with a personal injury lawyer. Experienced personal injury lawyers can provide invaluable insight into the value of your claim, they can help you choose the best strategy for proceeding, and they can carefully guide you through each step of your personal injury claim.

Many personal injury attorneys offer no-cost consultations and take cases on a contingency fee arrangement. In other words, payment is only required if they win the case, and it will come as a portion of the car accident settlement.

File a Lawsuit

When it comes time to file your lawsuit, you will do so with the Ontario Superior Court of Justice. In your car accident claim, you will need to provide sufficient evidence and a thorough description of how the accident occurred, what physical injuries were sustained and what level of compensation you are seeking.

Ensure that any details you provide are accurate and that you have collected all the necessary evidence before filing the lawsuit. This is an invaluable step that will give your case the best chance in court.

What evidence should you gather after a car accident

When you’re in an accident, claiming insurance and securing fair compensation for your losses can be challenging. As often, insurance companies reject genuine claims and reduce settlement amounts. But it doesn’t have to be that way!

After a car accident, it is important to gather as much information and evidence as possible. The more you can document—from photos of the damaged cars, police reports, or witness statements—the stronger your claim will be against an auto insurer.

  • PHOTOS AND VIDEOS

The first thing you should do immediately after a car accident is to take photographs and videos if you are well enough to do so. Pictures or videos are the best sources of strong evidence. They can show proof of damages and fault of other driver. It should consist of close-up shots of property damage and the crash scene in its entirety.

If you cannot take photos right after a crash, send someone else back to the scene while you visit the hospital. You can also visit local businesses in the area and ask them to show any surveillance recordings that might have captured the accident.

  • CONTACT INFORMATION OF EYEWITNESSES

Before leaving the accidental spot, the next thing to gather as evidence is the names and contact information of eyewitnesses. They can inform you in detail about how and why the accident happened. They may have observed the fault of the driver. If most of the eyewitnesses say the same thing, then their testimonials will become strong evidence to claim insurance.

  • POLICE REPORT NUMBER

Calling the police to report a car accident creates a public record of what happened, which can be useful for insurance claims.

A police report can include details about the accident, such as the directions and speeds of vehicles; whether one driver was breaking a law or not; and any insurance information. Once the police have arrived take time to explain what happened. Be sure that you get a report number for your statement before leaving.

  • MEDICAL REPORTS

After consulting a doctor about your car accident injuries, begin to gather medical documentation for your insurance claim. Your insurer will request evidence of your injuries and related expenses, such as medications, surgeries, and treatments.

You can take a free consultancy from the experienced car accident lawyers of Kalsi & Associates to claim your insurance after a car accident successfully. The team will help in gathering strong evidence behind the accident’s cause and your injuries.

What to Expect From A Personal Injury Lawyer?

A Personal Injury Lawyer is an expert attorney who provides legal assistance to those who allege to have been injured (physically or psychologically) as a result of delinquency of another person, company, government agency or any being.

The main goal of a personal injury attorney is to ensure settlements and justice for the person who has been adversely affected by the negligence of another person or company. They help to recover compensation money from the at-fault party and get the best deal. The cases involved in personal injury law include cases of motor vehicle accidents, accidental falls and slips, Catastrophic injury, and Traumatic brain Injury.

Let’s understand the tasks a personal injury lawyer performs to get you the justice and the best deal you deserve. Some general expectations from a Personal Injury Lawyer-

Analyzing Claims

The most important part of taking a personal injury case by an attorney is that the case should have the potential to win. In these cases generally, the lawyer does not get paid until the compensation is recovered so it becomes very important for personal injury lawyers to investigate the claims carefully so they could have a clear mindset for winning the case. They take good care in evaluating and screening the client.

Explaining Legal Rights

The other duty of the Personal Injury Lawyer is to explain your legal rights according to the situation you are in. You cannot trust insurance company agents to tell you the truth about the compensation and settlements, for this you need to have an expert on your side who can give you a clear image of your legal rights and the assessments of your claims.

He may also explain to you various approaches for recovering your damage and also the pros and cons of each approach so you can make your decision wisely according to your circumstances.

Gathering the Facts and Evidence

The Personal Injury Lawyer works with law enforcement officials to collect physical evidence and facts to build a case for the injured person. Evidence includes:

-Medical reports

-Police reports

-Surveillance footage

-Witness statement

-Photographs

This evidence may establish liability for who caused the accident and also explains the extent of the damage the complainant suffered.

Negotiations with the Parties

Negotiating could not be easy for some people but Personal injury Lawyers are experts at this. A Personal Injury Lawyer makes sure that the person or the party at fault must provide you with the maximum compensation which you deserve. Negotiations are very important to get the best deal from the other party. The injury lawyer works very passionately to settle the case fully in your favor.

Pleadings and Legal Representation

In case, if the other party refuses to pay the deserved compensation money to the victim, the Personal Injury Lawyer prepares a complaint against the person at fault. This complaint contains all the arguments and evidence that the defendant is responsible for the accident. The amount of compensation money required is also generally mentioned.

Although most cases get settled before trial, in case a trial happens, the personal injury lawyer will represent his client in court and will present his arguments.

Deals with Insurance Company

The cases which involve getting paid by the insurance company are the best cases for the personal injury lawyer. These lawyers negotiate with insurance companies regularly so they know how to get the maximum compensation by reviewing their policy details. The Personal Injury Lawyer handles all the communications with the insurance company. The insurance companies have officials who will try to lessen the liability of the company so you need an expert to deal with these companies.

These are some of the basic duties of a Personal Injury Lawyer. There are some roles too that depend on the case and the circumstances. If you are also looking for a personal injury lawyer near Brampton, Ontario then Kalsilaw.com. We have the best team of Personal Injury Lawyers who will take care of your compensation and will help you get the best deals. Contact us on our phone numbers or email id to know more about us.

What to do After a Car Accident in Ontario, Canada – Personal Injury Lawyer

If you are on the road, you are likely to indulge in a car accident now or then. Even the safest drivers can get in a terrible accident. It is very important to prepare yourself mentally to face such situations.

If you get hurt in the accident you can take help from a professional Personal Injury Lawyer to get your claims. But before that, you need to know the necessary steps taken right after you get into a car accident.

Take note of the following steps which you must follow after a Motor Vehicle Accident.

1.Try to Stay Calm

The first and very important step is to stay calm after the accident. We know, it’s not that easy but you have to try your best. Never run from the accident spot, stop your car right away. Don’t say sorry, don’t blame the other person too. Take a few deep breaths and focus on the details of the situation.

2.Collect Evidence and Take Photographs

When you feel okay, come out of your car and click photographs of the car and accident scene. Also, take photos of the injuries involved. Notice every single detail of the accident properly. This will help to determine the at-fault driver and is very important if you have to claim insurance. Keep an accurate record of what happened before leaving the accident scene. If you are seriously injured try to ask for help to collect the information. Do write down the license plate number, model and color of the vehicles involved in the accident. Also, note the time of the accident, road condition, weather condition etc. for further need.

3.Call Police if Needed

In minor accidents, it is not necessary to involve the police but under some circumstances, it is crucial to report your accident to the police. Rough guidelines, when to call the Police-

-In Ontario, you must report the accident if any of the cars involved in the accident exceeds $2000 in collective damage.

-If there are some serious injuries involved in the accident, call 911. The operator may suggest if you need police at the scene or not and will send medical help right away.

-If you find the other driver involved is intoxicated and causing some problems.

It is always advised to take help from the Police and never settle on your own. There are lots of things involved in an accident and everything is not in your hands at that moment. Still, if you don’t want to refer to the police, make sure to get proper information about the car and the driver involved.

4.Seek Medical Help

In case of very serious injuries, call 911 immediately for medical assistance. The injuries could be to you or your passengers but even if the other party is injured call for help out of empathy.

If you do not feel any serious injuries right away still you need to go to the doctor for a proper examination because certain injuries like brain trauma may not be instantly observed. Even after the immediate checkup, everything seems fine, you must have follow-up appointments as suggested by the physician. Keep track of all the pains and discomfort, it may also help you in creating a personal injury case.

5. Report to Your Insurer

Ontario has a no-fault insurance system and you deal with the at-fault driver’s insurance. But if you need to claim for your loss, call the insurance company within 7 days of the accident. Your insurance company will require some information from your end and will also investigate on their behalf. Provide all the important evidence and information about the accident to get a hassle-free claim. Otherwise, insurance companies always find a way to make you partly at fault and you would not be able to get your desired amount.

6.Contact Personal Injury Lawyers

This step is very important if you have a problem with any of the above steps. When you call for a Personal Injury lawyer, ask for a Car Accident Lawyer as they are the specialists in their job. The lawyer will work to protect your rights and will deal with the insurance companies too. The main job of these lawyers is to exclusively work for your best interest.

If the at-fault party is refusing to cooperate then the Car Accident lawyer will help you to pursue a claim against them. There are some limitations to pursuing a claim after a certain time frame so it is always advised to hire the best personal injury attorney as soon as possible to get the maximum benefit.

Pedestrian Dead, Driver Sought After in Ontario Hit and Run Case

Source:

CTV News

Peel Regional Police say that a man has died after an alleged hit and run in Mississauga, Ontario. According to the police, the said incident happened on Friday evening, i.e. on 30th of November, 2018. It is believed that the 54-year-old man was crossing the road when he was hit by a car. He died on the spot because of his injuries.

Police has said that the person driving the car did not stop and fled the scene. They are on a lookout now and are looking for a red colored Dodge Challenger manufactured in 2017 or 2018. This vehicle is also missing the right side mirror. The Police have also mentioned that the car is damaged on the right side, including the headlight and the bumper.

Peel Regional Police are asking the public to help them find the suspect and they have asked individuals to step forward if they have any knowledge about the accident.

Canada has seen a rise in pedestrian death in the last few years despite the government’s best efforts to make roads safer for people on their feet. 2017 was recorded as deadly in Ontario because of a hike in the number of deaths caused by accidents on the road. 2018 has been no better.

Individuals who are charged under Ontario’s hit and run law may have to face up to six months in prison. They may also lose the driving license and will have to pay a fine ranging between $600 and $2,000. Individuals who fail to remain at the scene of the accident may also see a steep hike in their insurance premiums.
