What to do After a Car Accident in Ontario, Canada – Personal Injury Lawyer

If you are on the road, you are likely to indulge in a car accident now or then. Even the safest drivers can get in a terrible accident. It is very important to prepare yourself mentally to face such situations.

If you get hurt in the accident you can take help from a professional Personal Injury Lawyer to get your claims. But before that, you need to know the necessary steps taken right after you get into a car accident.

Take note of the following steps which you must follow after a Motor Vehicle Accident.

1.Try to Stay Calm

The first and very important step is to stay calm after the accident. We know, it’s not that easy but you have to try your best. Never run from the accident spot, stop your car right away. Don’t say sorry, don’t blame the other person too. Take a few deep breaths and focus on the details of the situation.

2.Collect Evidence and Take Photographs

When you feel okay, come out of your car and click photographs of the car and accident scene. Also, take photos of the injuries involved. Notice every single detail of the accident properly. This will help to determine the at-fault driver and is very important if you have to claim insurance. Keep an accurate record of what happened before leaving the accident scene. If you are seriously injured try to ask for help to collect the information. Do write down the license plate number, model and color of the vehicles involved in the accident. Also, note the time of the accident, road condition, weather condition etc. for further need.

3.Call Police if Needed

In minor accidents, it is not necessary to involve the police but under some circumstances, it is crucial to report your accident to the police. Rough guidelines, when to call the Police-

-In Ontario, you must report the accident if any of the cars involved in the accident exceeds $2000 in collective damage.

-If there are some serious injuries involved in the accident, call 911. The operator may suggest if you need police at the scene or not and will send medical help right away.

-If you find the other driver involved is intoxicated and causing some problems.

It is always advised to take help from the Police and never settle on your own. There are lots of things involved in an accident and everything is not in your hands at that moment. Still, if you don’t want to refer to the police, make sure to get proper information about the car and the driver involved.

4.Seek Medical Help

In case of very serious injuries, call 911 immediately for medical assistance. The injuries could be to you or your passengers but even if the other party is injured call for help out of empathy.

If you do not feel any serious injuries right away still you need to go to the doctor for a proper examination because certain injuries like brain trauma may not be instantly observed. Even after the immediate checkup, everything seems fine, you must have follow-up appointments as suggested by the physician. Keep track of all the pains and discomfort, it may also help you in creating a personal injury case.

5. Report to Your Insurer

Ontario has a no-fault insurance system and you deal with the at-fault driver’s insurance. But if you need to claim for your loss, call the insurance company within 7 days of the accident. Your insurance company will require some information from your end and will also investigate on their behalf. Provide all the important evidence and information about the accident to get a hassle-free claim. Otherwise, insurance companies always find a way to make you partly at fault and you would not be able to get your desired amount.

6.Contact Personal Injury Lawyers

This step is very important if you have a problem with any of the above steps. When you call for a Personal Injury lawyer, ask for a Car Accident Lawyer as they are the specialists in their job. The lawyer will work to protect your rights and will deal with the insurance companies too. The main job of these lawyers is to exclusively work for your best interest.

If the at-fault party is refusing to cooperate then the Car Accident lawyer will help you to pursue a claim against them. There are some limitations to pursuing a claim after a certain time frame so it is always advised to hire the best personal injury attorney as soon as possible to get the maximum benefit.

A pickup truck flipped over after colliding with a car, at around 9.00 am, Thursday, on the eastbound lanes of QEW. The force caused the truck to flip over the median and into oncoming traffic. It then led to a chain reaction of collisions along the highway.

At least six vehicles were involved in the crash, including a transport truck that was hauling several vehicles, a dump truck, SUV, and several other vehicles. One man was trapped in the debris; luckily, he was extracted and transported to the hospital with only minor injuries.

The Ontario Provincial Police had to close most of the westbound lanes for about two hours to give room for clearing the wreckage. Traffic on the roads was given time to subside before the lanes were closed a second time.

It was to allow investigators to access the scene of the accident, safely. Traffic had to be steered off the highway. In turn, it led to the slow flow of traffic in the city.

Investigations into the cause of the collision are still underway. Traffic is back to normal as the lanes have since been reopened.

Unfortunately, a car accident can happen anytime and anywhere, changing someone’s life forever. Before you ever find yourself or a loved one involved in a car accident at some point, it is important to know what are the most common injuries that can occur in a car accident and how they can be treated. This way, it is easier to know the best place to get help and recover faster, but remember that every case is unique and only a health care professional can give the specific diagnosis.

Neck injuries

Car accidents victims commonly experience cases of whiplash, that causes damage to the neck muscles and ligaments. Victims diagnosed with whiplash often show symptoms of pain and muscle stiffness in the neck, lower back, hand, arm, or shoulder. They can also experience blurred vision, ringing in the ears and dizziness, just to mention a few. Medical treatment is recommended as soon as possible after a car accident because without the correct treatment, it can lead to the development of arthritis.

Back injuries

After a car accident, victims usually complain about lower back injuries that can lead to more serious cases of fractured vertebrae, for example. This kind of injury can be really painful and may appear right after the accident or even after a few days and the symptoms include arm and leg pain, muscle weakness, numbness or tingling. It is important to seek medical help right after the car accident in order to minimize nerve damage. In some cases, back injuries can be treated with pain medications that can be bought without prescription but most severe cases need stronger pain medication and even physiotherapy. If the non-surgical treatment is not enough to eliminate the pain, the last option may be a lumbar decompression surgery.

Spinal Cord Injuries

Car accident victims can suffer from spinal cord injuries and that can be very serious leading to paralysis and loss of feeling or reflexes. Cases of paralysis from a spinal cord can be reduced or reversed with proper medical treatment as long as it is done early.

Chest Injuries

Chest injuries are more likely to happen to the driver. In the car accident, the driver’s position makes it easier for him or her to suffer a chest injury like broken ribs and collapsed lungs for hitting the steering wheel or dashboard. In come cases, the victim can even suffer internal bleeding, cardiac arrest and damage to internal organs and abdomen. Even though the victim can experience severe bruising from wearing a seat belt during the car accident, it is just a small price to pay. If worn correctly, it can reduce the chance of death by 47% and more serious injuries by 52% and it is important to remember that wearing a seat belt is necessary at all times.

Shoulder Injuries

Because the shoulder can move in many directions, it makes it less stable than other joints being easier to suffer injuries in a car accident. Shoulder injuries’ symptoms include visible shoulder deformity, limited mobility of the joint, lots of pain and many others. Remember to never try to put a dislocated shoulder into place by yourself because that can cause even more damage. The right way to deal with this is to immediately proceed to the nearest emergency room and have proper medical treatment.

Internal Injuries

Do not think that injuries that can happen from a car accident are only visible from the outside. Internal injuries are dangerous because they can go unnoticed and lead to a more severe injury. Because they are harder to notice, pay attention to symptoms like pale skin, dizziness, overall cold feeling, abdominal pain and fatigue. After the car accident, even if it was a minor one, it is crucial to have proper medical treatment to have your internal organs checked. Otherwise, it can be lethal.

Brain, Head and Face Injuries

Car accidents caused by high-speed collisions can cause brain, head and face injuries that can possibly lead to comas and long-term cognitive issues. Even if there is no external sign of bruises on the head, the brain can be internally damaged and if not treated correctly, it can cause serious brain damage. Other conditions, like a dislocated jaw can be fixed back into the position but surgery may be necessary in some cases.

Broken Bones

Broken bones (arms, legs, knees, ankles and hips) are also common car accident injuries. They must be treated as soon as the car accident victim could go to the nearest hospital in order to get proper treatment. In some cases, physiotherapy may be required to repair broken bones.

Strains, Sprains, Bruising, Scrapes and Cuts

Do not mistake this kind of injury for something not worth treating. Even though it is the most common of car accident injuries, it can still cause lots of pain and discomfort to the victim weeks after the car accident happened. Treatment can include stitches and pain relievers with physiotherapy to restore body function.

Psychological Traumas

Car accident victims can also suffer from psychological traumas, especially if there is severe injury or death involved. Emotional distress can cause psychological traumas like anxiety, depression, posttraumatic stress disorder and more, interfering with the victim’s life considerably. This kind of case can be treated with proper counseling and medication.

Car insurance is a topic that has a big impact on Ontario’s population because it can cause major impacts. Every year, nearly 50,000 people suffer from car accident injuries in Ontario and many of them experience significant cases of injuries that can lead to a more problematic scenario. On June 1, 2016, the government has make more cuts to car accident benefits and that means people who have suffered from car accident injuries are going to have fewer benefits.

Accident claims

The impact of this measure is even bigger on the most vulnerable or marginalized people from Ontario because the ones with lower income are more likely to have physical jobs and be deprived to work because of possible injuries caused by car accidents.

That is why they are the ones that can benefit the most from having the assistance of a personal injury lawyer. The personal injury law firm can help them get the compensation and the assistance they need when they are injured by a car accident.
